Villawood forestSTAR

  1. The Villawood forestSTAR promotion applies to all contracts of sale of a lot in a Villawood Properties development entered into after 1 April 2008.
  2. During the promotion Villawood Properties will facilitate the transfer of a piece of land in Victoria to the State of Victoria of equivalent size to that being purchased.  The size of the land purchased shall be determined as at the time of settlement of the purchase by reference to the registered plan of subdivision. The transfer of land to the State of Victoria will be completed within a reasonable time of the completion of the settlement of the purchase of the lot.  If settlement of the purchase of the lot is for any reason delayed or not completed whether due to some act or default of either party or otherwise any obligation of Villawood Properties to transfer land to the State of Victoria pursuant to this promotion shall end.
  3. The promotion is subject to and conditional upon Villawood Properties obtaining the approval of the Department of Sustainability and Environment and the State of Victoria for the promotion and the State of Victoria’s acceptance of the land acquired or to be acquired on behalf of Villawood Properties for transfer to the State of Victoria.
  4. Upon completion of the transfer of land to the State of Victoria Villawood Properties has no control over the use to which the land is put.  Villawood Properties makes no representations or warranties as to the quality or suitability of the land transferred to the State of Victoria.
  5. Villawood Properties reserves the right in its sole discretion to vary or end this promotion at any time.

Villawood kidsSTAR

  1. The Villawood kidsSTAR promotion applies to all contracts of sale of a lot in a Villawood Properties development entered into after 1 April 2008.
  2. During the promotion Villawood Properties will donate $100.00 to the Royal Children’s Hospital Foundation Melbourne or such other charity or project as Villawood Properties determines.  The donation shall be made within 14 days of the settlement of the purchase of the lot.
  3. Villawood Properties reserves the right to change the recipient of the donation at any time provided that the recipient shall be a registered charitable organisation.
  4. Villawood Properties reserves the right in its sole discretion to vary or end this promotion at any time.

Wishlist
The Wishlist is a web based document that will evolve to take into account new innovations as they arise.  Villawood Properties welcomes any suggestions for new innovations or improvements to the Wishlist.

The Wishlist has been compiled and reviewed by sustainable building specialists. It is based on a number of assumptions and is for representative purposes only. Villawood Properties makes no representations or warranties as to the accuracy of the savings identified. These figures may not reflect actual savings.

Competition

  1. WHO MAY ENTER
  2. The only persons who may enter the Villawood enviroSTAR competition and be eligible to be awarded a prize are those who have purchased a lot in a Villawood Properties development and who have an occupancy permit issued after 1 April 2008 for a home constructed upon that lot.


  3. ENTRANTS BOUND BY CONDITIONS
  4. By participating, entrants agree to be bound by these conditions.


  5. HOW TO ENTER
  6. To enter, entrants must have purchased a lot from a Villawood Properties development and constructed a home on that lot. Entrants must also have an occupancy permit issued during the period of the competition. The entrant must read these conditions and submit their Wishlist (which must exceed the minimum energy / water standard as determined by Villawood Properties from time to time) and contact details by post to Villawood Properties, Level 1, 6 Riverside Quay, Southbank Vic 3006. The entry must be received by Villawood Properties within 3 months of the date of the issue of the occupancy permit and within 2 years of the stage title being released for the relevant lot.


  7. LIMITATIONS ON ENTRY
  8. Entries are limited to one per lot.


  9. DURATION
  10. This competition commences on 1 April 2008 on a such later date as may be determined by Villawood Properties in its sole discretion.
    All entries received by close of business on the last day of the month will be eligible for one of that month's prizes.


  11. SELECTION OF WINNER
  12. Within 7 days of the end of each month Villawood Properties will choose one winner as the entrant with the highest achieved carbon savings or reduction in the first year and another winner as the entrant with the highest achieved water savings.
    Chance plays no part in determining the winners except in so far as it determines the amount of the prize.
    If there is equality of savings between two different entrants then Villawood Properties may apportion the prize. The decision of Villawood Properties about the winners of the prizes shall be based upon the Wishlist submitted by the entrant and an inspection of the entrant's home which shall be final and no correspondence will be entered into.
    Failure to allow inspection of the entrant's home by Villawood Properties or its representative will result in the entitlement to a prize being forfeited.


  13. PRIZES
  14. There will be two prizes awarded each month one for the entrant with the highest achieved carbon savings or reduction in the first year and one for the entrant with the highest achieved water savings. One entrant is only eligible to win one prize.
    Each winner will receive $2,000. Villawood Properties reserves the right to substitute a prize item of equal or greater value.
    The prize is not transferable. Any taxes (other than GST, if any) which may be payable as a consequence of a winner receiving the prize are the sole responsibility of the winner.


  15. EXCLUSION OF LIABILITY
  16. The winner must sign and return any liability release and indemnity provided by Villawood Properties as a condition of the prize being awarded. Failure to return the signed releases and indemnities will result in the entitlement to the prize being forfeited and the selection of another winner.
    This clause does not affect, and is not intended to affect, any rights a consumer might have, which are not able to be excluded under applicable Australian consumer protection laws.
    To the fullest extent permitted by law, any liability of Villawood Properties or its servant or agents for breach of any such rights is limited to the payment of the cost of having the prize supplied again.


  17. WINNER NOTIFICATION AND PUBLICATION
  18. The winner will be notified by mail and may also be notified by telephone and/or email, using the details provided in their entry, and the name and suburb of the winner may be published on any advertising or other promotional material of Villawood Properties.


  19. INTERNET
  20. If for any reason this competition is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of Villawood Properties which corrupt or affect the administration security, fairness, integrity or proper conduct of this competition, Villawood Properties reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the competition.
    Villawood Properties assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of, entries. Villawood Properties is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any email or entry to be received by Villawood Properties on account of technical problems or traffic congestion on the Internet or at any Website, or any combination thereof, including any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading any materials in this competition.


  21. ENTIRE CONDITIONS
  22. These conditions constitute the entire agreement of the parties relating to the entry and the conduct of the competition but may be varied from time to time at the discretion of Villawood Properties.
